Terms and Conditions
1. General Provisions and Definitions
- 1. These terms and conditions (hereinafter “Terms”) govern the rights and obligations of the contractual parties arising from a purchase agreement concluded remotely via the online store www.petratoth.sk (hereinafter also "online store" and/or "e-shop") and are an integral part of such purchase agreement.
- 2. The term seller refers to the company Petra Toth, s.r.o., Muškátova 2, 900 21 Svätý Jur, Company ID: 50 587 595, Tax ID: 2022614649, VAT ID: SK2120393121, registered in the Commercial Register of the Bratislava III District Court in Section Sro, insert no. 146425/B (hereinafter “operator” or “seller”).
- 3. The term buyer refers to a natural or legal person who purchases goods via the online store as a consumer or as a business entity.
- 4. The term consumer within the meaning of §2a of Act No. 250/2007 Coll. on Consumer Protection refers to a natural person acting outside the scope of business activity, employment, or profession.
- 5. The term entrepreneur within the meaning of §2(2) of Act No. 513/1991 Coll., Commercial Code, refers to a person registered in the commercial register; a person conducting business under a trade license; a person conducting business under a permit other than a trade license; or a natural person engaged in agricultural production registered under a special regulation.
- 6. Legal relations between the seller and a consumer buyer not governed by these Terms are subject to the relevant provisions of Act No. 40/1964 Coll., Civil Code, Act No. 250/2007 Coll. on Consumer Protection, Act No. 102/2014 Coll. on Consumer Protection in Distance or Off-Premises Contracts, and other generally binding legal regulations.
- 7. Legal relations between the seller and an entrepreneur buyer not governed by these Terms are subject to the relevant provisions of Act No. 513/1991 Coll., Commercial Code, and other generally binding legal regulations.
- 8. Goods refer to products offered in the online store www.petratoth.sk.
2. ORDER AND CONCLUSION OF PURCHASE AGREEMENT
- 1. The buyer may order goods offered in the online store www.petratoth.sk by correctly and completely filling out the order form in the online store.
- 2. A condition for the validity of an electronic order is the truthful and complete completion of all required fields and information requested by the registration form, including a phone contact.
- 3. A truthfully and completely filled-out order is considered a proposal for a contract. By submitting the order, the buyer declares that they have read and agreed to these terms and conditions and the complaints procedure.
- 4. An order (or part of it) confirmed by the seller is considered binding, and upon such confirmation, a purchase contract between the contracting parties is concluded. The automatically generated notification of receipt of the order, which is sent to the buyer’s e-mail address immediately after the order is placed, is not considered a binding confirmation.
3. ORDER CANCELLATION
- 1. The buyer has the right to cancel the order without giving a reason until it is confirmed by the seller.
- 2. The seller reserves the right to refuse proper processing of the order or its part if:
2.1. The order cannot be confirmed due to incorrect phone number or unavailable email;
2.2. The buyer previously did not accept goods or violated the Terms in another way;
2.3. The goods are no longer manufactured or supplied, or the price has significantly changed. In such cases, the seller will contact the buyer immediately to agree on the next steps. Any paid amounts will be refunded within 15 calendar days.
4. PURCHASE PRICE OF GOODS
- 1. Prices are stated in EUR, including VAT. The seller reserves the right to change prices.
- 2. Shipping and handling costs are specified in section 5 of these Terms.
- 3. Discounted prices are clearly marked with “DISCOUNT” and are valid until stock runs out or during the specified period. The original price is also indicated.
- 4. The buyer is informed of the final price before confirming the order.
- 5. The invoice serves as proof of sale and delivery note.
- 6. The purchase price is the price valid on the day the order is sent by the buyer.
5. SHIPPING AND HANDLING
6. PAYMENT CONDITIONS
- 1. The buyer is obliged to indicate in the order the chosen payment method – by using PayPal, credit card payment via GOPAY, Stripe, or cash on delivery.
- 2. In the event that the buyer chooses payment by credit card, PayPal, GOPAY, or Stripe, and the price of the ordered goods is not paid in full, the seller has the right to suspend or refuse delivery of the goods until the full payment is received.
7. DELIVERY TERMS
- 1. Delivery depends on availability and seller’s capacity, no later than 30 days after order confirmation.
- 2. If goods are out of stock, the seller will inform the buyer and may extend delivery or refund prepayment within 14 days.
- 3. Buyer is informed of order status via email and can check it online.
- 4. Buyer must accept goods at the address specified in the order. Failure to do so allows the seller to claim damages or refuse future deliveries.
- 5. Ownership passes to the buyer upon receipt and payment.
- 6. Delivery is via Packeta courier to the selected address or pickup point.
- 7. Delivery to EU or other countries requires prior written buyer consent regarding shipping costs and terms.
- 8. Seller is not liable for delays or loss caused by the carrier or force majeure.
- 9. If shipment is returned due to buyer’s fault, the seller will contact the buyer by email. Additional shipping fees apply if reshipped.

8. GIFT VOUCHERS
- 1. The gift voucher can be used in the online store www.petratoth.sk or in physical stores (kiosks) located in the Eurovea Shopping Center, Avion Shopping Park, or Aupark Košice.
- 2. When ordering through the online store, it is possible to use multiple gift vouchers at once.
- 3. To redeem a gift voucher in the online store, enter the code shown on the voucher in the appropriate field. After verifying the validity of the gift voucher, its value will be deducted from the total order amount as a discount in euros.
- 4. When shopping in physical stores, it is also possible to use multiple gift vouchers at once. To redeem the voucher, you must present a valid gift voucher.
- 5. The gift voucher is valid for 6 months from the date of purchase. The expiration date is stated on the voucher. The validity of the voucher cannot be extended after its expiry date.
- 6. The value of the gift voucher is stated as an amount including VAT.
- 7. If the total value of the online order exceeds the value of the applied gift voucher(s), the remaining amount must be paid according to the chosen payment method. In physical stores, the difference can be paid in cash or by card.
- 8. If the total order amount is lower than the value of the gift voucher, the voucher cannot be used. The gift voucher cannot be used partially.
- 9. The gift voucher cannot be exchanged for cash.
- 10. In the case of withdrawal from the contract and subsequent return of goods paid for with a gift voucher, the used gift voucher will be reissued to the customer.
- 11. Loss, damage, or destruction of the gift voucher does not entitle the holder to a replacement or a refund of its value.
9. VOLUNTARY CONTRIBUTION
- 1. Buyers can contribute by rounding up their order or making a voluntary donation to support cultural heritage projects. Contributions are non-refundable if the order is returned after payment.
10. WITHDRAWAL FROM THE CONTRACT
- 1. Withdrawal by a consumer is regulated by Act No. 102/2014 Coll.
- 2. Consumers may withdraw within 14 days of receipt using a withdrawal form.
- 3. Withdrawal cancels the contract from the beginning.
- 4. Seller will refund payments within 14 days of withdrawal notification, after the goods are returned.
- 5. Returned goods must be unused, undamaged, and in original packaging.
- 6. Any gifts included with the order must also be returned if the contract is withdrawn.
- 7. Buyer must return goods within 14 days of withdrawal.
- 8. Buyer bears return shipping costs.
- 9. Seller accepts returns only if goods are complete, undamaged, and include original purchase documents.
11. WARRANTY AND COMPLAINTS
- 1. The buyer may file a complaint only for goods purchased through the online store www.petratoth.sk.
- 2. The warranty period is 24 months and begins on the day the goods are received by the buyer. (The warranty period for goods purchased by a legal entity or a natural person with a company ID number is 12 months and also begins on the day the goods are received.)
- 3. The warranty does not cover defects caused by improper use, incorrect storage, or damage caused by the buyer.
- 4. Buyers located in Slovakia or the Czech Republic can file a complaint by filling out the complaint form via their account on www.petratoth.sk or by completing the form available in the “Complaints” section of the website. The claimed goods must be sent according to the instructions received by email within 24 hours after submitting the form. - 5. Buyers located outside Slovakia or the Czech Republic can file a complaint by filling out the complaint form via their account on www.petratoth.sk or by completing the form available in the “Complaints” section of the website. The claimed goods must be sent to: Petra Toth, s. r. o., Muškátová 2, 900 21 Svätý Jur, Slovak Republic. The buyer will receive email instructions within 24 hours after submitting the form. - 6. If the defect can be remedied, the buyer has the right to have it repaired free of charge, properly, and in a timely manner. The seller is obliged to remove the defect without undue delay. Once the defect is repaired or the product is replaced, the complaint is considered resolved.
- 7. If the defect cannot be remedied and prevents the proper use of the product, the buyer has the right to a replacement or to withdraw from the contract. The same rights apply if the defect recurs or multiple defects prevent proper use of the product.
- 8. In the case of non-repairable defects, the buyer has the right to an appropriate price reduction.
- 9. The seller undertakes to determine how the complaint will be handled within 3 working days from receipt of the claimed goods, but no later than 30 days from receipt.
- 10. The consumer may contact the seller to request a remedy if they are not satisfied with how their complaint was handled. Any disputes between the seller and buyer may be resolved amicably or through alternative dispute resolution. You may contact us at hello@petratoth.sk.
- 11. If no agreement is reached, the consumer may contact the Slovak Trade Inspection as one of the possible entities for alternative dispute resolution and file a proposal according to §12 of Act No. 391/2015 Coll. as amended. For court proceedings, either party may contact the competent court in the Slovak Republic.
- 12. All notices and other written acts required by law or by agreement shall be delivered to the other party at its last known address.

13. FINAL PROVISIONS
- 1. These Terms apply as posted on the website on the day the order is placed and accepted by the buyer.
- 2. Seller reserves the right to modify or supplement these Terms.
- 3. Consumers who feel their rights were violated may contact an alternative dispute resolution body under Act No. 391/2015 Coll.
- 4. Terms take effect on 02.02.2024 and replace previous versions.
